Notice and Takedown Policy

WeSendit Media AG respects the rights of third parties, in particular intellectual property rights, personality rights, and data protection claims. As a technical intermediary, WeSendit provides infrastructure for the transmission and storage of content, but does not perform prior content monitoring.

This policy regulates the procedure for reporting and processing allegedly illegal content (Notice-and-Takedown-Policy).

1. General Principle

WeSendit is not obliged to proactively monitor all content transmitted or stored via its services.

However, if WeSendit receives concrete and sufficiently substantiated indications of a legal violation, an examination and, if necessary, appropriate action will be taken.

2. Who Can File a Report

A report can be filed by: rights holders, authorized representatives, or persons whose legally protected rights are affected. The reporting party must be able to demonstrate that they are authorized to assert the claimed legal violation.

3. Requirements for an Effective Report

An effective report must contain at least: a clear identification of the objected content; the exact URL or technical localization; a description of the asserted legal violation; a statement that the information is correct to the best of knowledge; and proof of authorization to assert the claim.

Incomplete or obviously unsubstantiated reports can be rejected.

4. Verification Procedure and Measures

Upon receipt of a formally sufficient report, WeSendit will check the details, perform a legal assessment, inform the affected user if appropriate, and take reasonable measures.

Possible measures include: temporary blocking of the content, permanent removal, restriction of access, or blocking the user account. Decisions are made in compliance with statutory provisions and the principle of proportionality.

5. Counter-Statement

Affected users can submit a counter-statement if they believe that the removal or blocking occurred without justification. The counter-statement must demonstrate that no legal violation is present. WeSendit reserves the right to release content again after re-examination.

6. Abusive Reports

WeSendit does not tolerate abusive or intentionally false reports. Anyone who intentionally makes incorrect statements or raises groundless claims can be held liable and excluded from using the services.
