Data Sovereignty

Data sovereignty is a central principle of the services provided by WeSendit Media AG. All rights to uploaded, transmitted, managed, or stored content remain solely and unrestrictedly with the respective user or the lawful rights holder.
WeSendit does not acquire any ownership, copyright use rights, or other commercial exploitation rights to the data provided by the user. This applies regardless of whether the content is managed via File Sharing, File Management, Cloud Storage, the WeSendit Node Network, or connected third-party providers.
The user grants WeSendit only those limited rights that are technically and legally necessary to perform the services requested by the user. These rights are non-exclusive, non-transferable, and limited to the scope and duration of the respective service delivery. No use of the content for our own commercial, advertising, analytical, or business purposes takes place.
In File Sharing, the user decides solely on the provision and sharing of their content. The user determines the recipients, the scope of release, and the duration of availability. WeSendit has no influence on these decisions and does not intervene in the transmission process.
In File Management, organizational, technical, and economic control over the stored content remains with the user. This applies whether storage occurs via the WeSendit cloud infrastructure, the WeSendit Node Network, or third-party providers selected by the user. Decisions regarding storage, release, deletion, archiving, or access restrictions are made exclusively by the user or through processes authorized by them.
WeSendit only processes technical metadata required for the operation, security, integrity, and provision of the services. Content evaluation, analysis, or profiling based on stored files does not take place as a matter of principle.
Content inspection occurs only if required by mandatory legal obligations, official or court orders, or to avert concrete security risks. Such measures are always carried out in compliance with applicable data protection and proportionality principles.
Data sovereignty therefore remains with the user or the respective rights holder throughout the entire data lifecycle, from transmission and storage to deletion.
"Full data sovereignty" applies only to the Node Network in the sense of our GTC. WeSendit does not acquire any ownership rights to stored content.
The user alone determines the storage, structuring, release, migration, and deletion of their content. WeSendit receives only the technically necessary, non-exclusive, and non-transferable license to enable storage and management within the framework of the chosen product.
No content analysis or commercial exploitation of stored content by WeSendit takes place.
